Terms of Use

1. Agreement

These terms are an agreement between you and the operator of Svanu ("we", "us"). By downloading or using the Svanu iOS app, you agree to them. If you do not agree, do not use the app. Apple's standard Licensed Application End User License Agreement also applies to your download from the App Store; where these terms conflict with it, these terms govern to the extent permitted.

2. License

We grant you a personal, non-exclusive, non-transferable license to use Svanu on Apple devices that you own or control, as permitted by the App Store terms. You may not copy, modify, distribute, sell, or lease any part of the app, and you may not reverse engineer it except where the law permits this despite these terms.

3. The service

Svanu computes health and fitness scores from data you permit it to read, and offers logging, insights, and an AI coach. A free tier includes the core features. Svanu Pro is a paid subscription that adds features such as a higher AI message allowance, long-term trends and correlations, higher AI photo logging caps, and widgets. We may improve, change, or discontinue features over time; the free tier's core scoring features are not moved behind the paywall retroactively without notice.

4. Subscriptions and billing

• Svanu Pro is an auto-renewing subscription: $2.99 per month or $19.99 per year, charged in your local currency equivalent by Apple to your Apple Account.
• New subscribers get a 7-day free trial where offered. If you do not cancel at least 24 hours before the trial ends, the paid period starts automatically.
• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
• You can manage and cancel the subscription in your App Store subscription settings. Deleting the app does not cancel it.
• Billing, payment data, and refunds are handled by Apple under Apple's terms. We never see your payment details. Refund requests go through Apple.
• If prices change, the change applies from your next renewal, and Apple notifies you in advance as its rules require.

5. No accounts, your data, your responsibility to export

Svanu does not use accounts. Your subscription is tied to your Apple Account, and usage caps are enforced with a random per-install identifier. Your health data and logs are stored on your device, as described in the privacy policy. If you delete the app, that local data is deleted with it. Use the built-in export if you want to keep a copy.

6. Medical disclaimer

Svanu is not a medical device. Its scores, insights, estimates, and AI responses are for general wellness and informational purposes only. They are not medical advice, and they do not diagnose, treat, cure, or prevent any disease or condition. Do not use the app as a substitute for professional medical advice, and never delay seeking it because of something the app showed you. If you think you have a medical emergency, call your local emergency number.

7. Acceptable use

You agree not to misuse the app or its AI features, including attempting to circumvent usage caps or subscription checks, probing or disrupting our servers, or using the service in violation of applicable law.

8. Intellectual property

The app, its design, and its content (excluding your data) are owned by us or our licensors and are protected by law. These terms grant you no rights other than the license above.

9. Disclaimer of warranties

The app is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. Health metrics depend on the quality of the sensor data your devices provide; we do not warrant their accuracy or completeness.

10. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, arising from your use of the app. Our total liability for any claim is limited to the amount you paid us through the app in the 12 months before the claim arose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you; nothing here limits liability that cannot be limited by law.

11. Changes to these terms

We may update these terms. The current version is published at this URL with its "Last updated" date. Material changes will be flagged in the app. Continued use after a change takes effect means you accept the updated terms.

12. Termination

You can stop using the app at any time. We may suspend or terminate access to server-backed features if you materially breach these terms. Sections 6, 8, 9, and 10 survive termination.

13. Governing law

Pending before publication: governing law and venue, to be set by the owner together with the operating entity's legal name and address.
